International Traffic in Arms Regulations (ITAR) compliance is required by the U.S. Government for all manufacturers, exporters, and brokers of defense articles, defense services or related technical data. For a company to become ITAR compliant, they must register with the State Department's Directorate of Defense Trade Controls (DDTC) along with fully understanding and abiding by the ITAR for all applicable United States Munitions List (USML) goods or services.
With the increase in global business, more companies are requiring that their supply chain trading partners be ITAR certified or ITAR compliant. In these situations, suppliers are certifying that they operate in accordance with the ITAR when they accept being a supplier for the USML prime exporter.
Exports include both physical products shipped to foreign countries, and "deemed exports" of controlled knowledge or intellectual property to foreign persons, both in the U.S. and abroad. Unless authorization licenses or special exemptions are obtained, ITAR requires that the exporter of record only share these items with U.S. persons and organizations.
Complying with ITAR is a difficult task with stringent requirements on managing agreements, licenses, and other obligations, including record keeping, document version control, visitor management, and information security. The failure to comply with these ITAR requirements can result in fines, denial of further exporting privileges, and jail terms for the violator, company executive and board members.
